Terms of Service

1. Acceptance of terms

By creating an account or using SafeMind (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms form a legally binding agreement between you and SafeMind.

2. Who may use the Service

The Service is intended exclusively for parents or legal guardians ("Parents") who wish to monitor the AI tool usage of their minor children ("Teens"). You must be at least 18 years old and a legal resident of your country of use to create an account.

You may not use the Service to monitor any person without a lawful basis to do so. Using SafeMind to monitor a person who is not your minor child, or without appropriate legal authority, is strictly prohibited and may be unlawful.

3. Parental consent and transparency

You, as the parent or guardian, are solely responsible for:

  • Determining whether and how to inform your child that their ChatGPT conversations may be monitored.
  • Complying with all applicable local laws regarding the monitoring of minors, including any consent requirements.
  • Installing and configuring the SafeMind app on the teen's device in a lawful manner.

SafeMind strongly recommends discussing the use of this Service with your teen as part of an open conversation about online safety.

4. Not a medical or clinical service

SafeMind is a technology tool, not a medical, psychological, or clinical service. The Service is not intended to diagnose, treat, cure, or prevent any mental health condition or disorder. It is not a substitute for professional mental health care, therapy, counseling, or emergency services.

If you believe your child is in immediate danger or experiencing a mental health crisis, contact emergency services (e.g., 911 or your local equivalent) immediately.

Alerts generated by SafeMind are automated and may contain errors. They are intended to prompt parental awareness and conversation — not to serve as a clinical assessment of your child's wellbeing.

5. No guarantee of detection

The Service uses AI-based analysis to detect potentially concerning content. This analysis is imperfect. SafeMind does not guarantee that all concerning content will be detected, and the Service may generate false positives (alerts for non-concerning content) or false negatives (failure to flag genuinely concerning content). You should not rely solely on SafeMind for your child's safety.

6. Account and device linking

You are responsible for maintaining the security of your parent account credentials. You must not share your account with others. Each parent account may be linked to one or more teen devices. You may unlink a device at any time from the parent dashboard.

You must notify us immediately at support@safemind.app if you suspect unauthorized access to your account.

7. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Attempt to reverse-engineer, decompile, or interfere with any part of the Service.
  • Monitor any individual who is not your minor child without lawful authority.
  • Use the Service to harass, intimidate, or harm any person.
  • Circumvent any technical measures or access controls in the Service.

8. Intellectual property

All software, content, and materials comprising the Service are the property of SafeMind or its licensors and are protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the Service.

9. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranty of any kind. To the maximum extent permitted by applicable law, SafeMind disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the maximum extent permitted by applicable law, SafeMind shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Service — even if we have been advised of the possibility of such damages. In no event shall SafeMind's total liability to you exceed the amount you paid for the Service in the twelve months preceding the claim.

11. Termination

You may terminate your account at any time by deleting it through the parent dashboard or by contacting us at support@safemind.app. Upon termination, all your data will be permanently deleted within 72 hours.

We reserve the right to suspend or terminate your account, with or without notice, if we determine that you have violated these Terms, engaged in abusive or unlawful conduct, or if required by applicable law.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated to registered parent accounts by email at least 14 days before they take effect. Continued use of the Service after the effective date of a revised version constitutes acceptance of the new Terms.

13. Governing law

These Terms are governed by and construed in accordance with the laws of the State of Israel, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts located in Israel.
